This is a request under the Freedom of Information Act the Sunshine Act and Open Records Laws O.R.S. 192.410 et seq.

I request that a photo copy of the following documents be provided to me:

  • A photocopy of your Public Official Surety Bond ORS 332.525
  • A photocopy of the governing board of education blanket surety bond if your board requires the members to be bonded under a blanket bond.
  • A photocopy of your Errors & Omissions (E&O), a Surety Liability Insurance policy, and the Duty of Care policy if applicable.
  • A photocopy of your school board General Obligation Bonds if applicable.
  • A photocopy of your general long term bond for the school board if applicable.
  • A photocopy of your school board Crime Policy if applicable.
  • A photocopy of your Risk Management Policy if applicable.

    • The documents should indicate the policy number and the insured amount of the policy.

  • A photocopy of the Faithful Performance Bond if applicable.
  • A photocopy of the Fidelity Bond if applicable.
  • A photocopy of the Public Employee Dishonesty Policy if applicable.
  • A photocopy of the Public Employee Blanket Bond if applicable.
  • A photocopy of the Statutory Bond if applicable.
  • A photocopy of the Official Bond if applicable.
  • A photocopy of the power of attorney for the surety bond company.
  • A photo copy of the Blanket Bond power of attorney for the surety bond company if applicable.
  • A photocopy of your oath of office.

 

I am a private citizen seeking information concerning your public official surety bond, governing school board blanket bond, or a self-liability insurance policy that you are required by the state of Oregon to obtain before swearing the oath of office.

Public Official Surety Bond requests fall under the Freedom of Information Act (FOIA), 5 U.S.C. § 552, The Sunshine Act 5 U.S.C. § 552b, Open Records Laws O.R.S. 192.410 et seq, and by law you are obligated to supply me with this information.

Oregon State Revised Code 204.020 When terms of office commence; filing oath of office and undertaking. (1) The term of office of each officer elected pursuant to ORS 204.005 commences on the first Monday of January next following election to office.

ORS 332.525 Bonds for Personnel: (1)The persons authorized to handle district funds, including the person designated to be custodian of district funds under ORS 328.441 (Custody and disbursement of school district funds), shall be bonded in an amount to be determined by law and by the district school board. The board may require bonds on such other persons as the board may determine.

(2)The district school board shall require the district school clerk to be bonded in an amount to be determined by the board as reasonably necessary to protect the district against loss.

(3)The costs of bonds under subsections (1) and (2) of this section shall be paid by the district school board in the same manner as other expenses of the district are paid. All bonds shall be justified by a surety company authorized to do business in this state. [1965 c.100 §161; 1975 c.770 §28]

ORS 328.441 Custody and disbursement of school district funds: (1)Common school district boards and union high school district boards shall designate the persons to be custodians of school funds of their respective districts. Such funds shall be disbursed only in the manner provided by ORS 328.445 (Disbursement of school funds by check or warrant) (1).

(2)For the purpose of receiving deposits of school funds, the district school board of each district described in subsection (1) of this section shall designate such bank or banks within the county or counties in which the district is located, as the board deems safe and proper depositories for school district funds. The custodian designated under subsection (1) of this section is not liable personally or upon official bond of the custodian for moneys lost by reason of failure or insolvency of any bank that becomes a depository under this subsection.

(3)If the district does not designate a custodian of school funds, the county treasurer or county fiscal officer shall be custodian of funds of all school districts. School district funds in the county treasurer’s or county fiscal officer’s custody shall be disbursed only upon warrants drawn on the county treasurer or county fiscal officer by the district school board in the manner provided by law.

(4)The proceeds of the sale of school district bonds or warrants shall be used solely for the purpose for which the bonds or warrants were issued, including reduction of existing bond or warrant indebtedness. A county governing body may require, by ordinance, for the filing by each officer under ORS 204.005, prior to that officer assuming office, of an official undertaking with such surety as the governing body determines necessary or of an irrevocable letter of credit issued by an insured institution, as defined in ORS 706.008, in either case in a reasonable amount with the county governing body.
