Re: Freedom of Information Act Request
This is a request under the Freedom of Information Act, The Sunshine Act 5 U.S.C. § 552b, and Montana Code Annotated 2-6-307. Certified copies of official records. I request that a photocopy of the following documents be provided to me:
I am a private citizen seeking information concerning your public official surety bond, or the Errors & Omissions (E&O), and or the Duty of Care policy that you are required by the state of Montana to obtain before swearing the oath of office.
Montana Code Annotated 2-6-307. Certified copies of official records
(1) The Montana historical society shall reproduce and certify copies of official records in its possession upon application of any citizen of this state.
(2) The certified copy of an official record has the same force in law as if made by the original custodian.
MT Code § 2-9-804
(1) The city or town council or commissioners shall purchase all surety bonds for city officers and employees.
(2) Bonds purchased by the city or town council or commission must be executed by responsible insurance or surety companies authorized and admitted to execute surety bonds in this state or by a self-insurance pool insuring cities or towns as authorized under 2-9-211.
Public Official Surety Bond requests fall under the Freedom of Information Act (FOIA), 5 U.S.C. § 552, The Sunshine Act 5 U.S.C. § 552b, Montana Code Annotated 2-6-307. Certified copies of official records by law you are obligated to supply me with this information.
It is public knowledge in the State of Montana that all school boards in the state and the superintendents are required to be bonded, carry a surety liability insurance policy, an Errors & Omissions, or a Duty of Care policy.
