Re: Freedom of Information Act Request
This is a request under the Freedom of Information Act, The Sunshine Act 5 U.S.C. § 552b, and Minnesota Data Practices Act § 13.01 et seq. I request that a photocopy of the following documents be provided to me:
I am a private citizen seeking information concerning your public official surety bond, or the Errors & Omissions (E&O), and or the Duty of Care policy that you are required by the state of Michigan to obtain before swearing the oath of office.
574.24 OFFICIAL BONDS, SECURITY TO WHOM; ACTIONS.
The official bond or other security of a public officer, whether with or without sureties, shall be security to all persons severally for the official delinquencies against which it is intended to provide, as well as to the obligee designated therein, and when no other provision is made by law it shall run to the state. When a public officer, by official misconduct or neglect, forfeits the bond or renders the officer’s sureties liable thereon, any person injured thereby, or who is by law entitled to the benefit of the security, may bring an action thereon, in the person’s own name, against the officer and the sureties, to recover the amount to which the person is entitled by reason of the delinquency; and a judgment in favor of a party for one delinquency does not preclude the same or another party from an action on the same security for another delinquency.
Public Official Surety Bond requests fall under the Freedom of Information Act (FOIA), 5 U.S.C. § 552, The Sunshine Act 5 U.S.C. § 552b, Minnesota Data Practices Act § 13.01 et seq., and by law you are obligated to supply me with this information.
It is public knowledge in the State of Minnesota that all school boards in the state and the superintendents are required to be bonded, carry an surety liability insurance policy, an Errors & Omissions, or a Duty of Care policy.
Thank you for your consideration of this request.
